{"id":15678,"date":"2024-01-11T01:36:12","date_gmt":"2024-01-11T06:36:12","guid":{"rendered":"https:\/\/newssprinters.com\/index.php\/sport\/why-manchester-city-are-being-sued-by-superdry\/11\/01\/2024\/"},"modified":"2024-01-11T01:36:12","modified_gmt":"2024-01-11T06:36:12","slug":"why-manchester-city-are-being-sued-by-superdry","status":"publish","type":"post","link":"https:\/\/newssprinters.com\/index.php\/sport\/why-manchester-city-are-being-sued-by-superdry\/11\/01\/2024\/","title":{"rendered":"Why Manchester City are being sued by Superdry"},"content":{"rendered":"<p>\n<\/p>\n<div>\n<p><a class=\"ath_autolink\" data-id=\"654\" href=\"https:\/\/theathletic.com\/football\/team\/manchester-city\/\" target=\"_blank\" rel=\"noopener nofollow\">Manchester City<\/a>\u2019s players wore modified training gear for their pre-match warm-up on Sunday following a High Court trademark infringement claim from fashion brand Superdry.<\/p>\n<p>It emerged last week that City are being sued for damages over the use of the words Super Dry \u2014 a type of beer sold by one of their main sponsors, Asahi \u2014 on their training kit.<\/p>\n<p>Some immediate implications have become apparent: up until Wednesday, January 3, the day Superdry\u2019s claim was first reported by Law360, City\u2019s players have worn bibs, sweatshirts and coats that bear the words \u2018Asahi Super \u201cDry\u201d\u2019 in training and before matches.<\/p>\n<p>Since the middle of last week, however, and including for the warm-up before their <a class=\"ath_autolink\" data-id=\"46\" href=\"https:\/\/theathletic.com\/football\/fa-cup\/\" target=\"_blank\" rel=\"noopener nofollow\">FA Cup<\/a> match with <a class=\"ath_autolink\" data-id=\"695\" href=\"https:\/\/theathletic.com\/football\/team\/huddersfield-town\/\" target=\"_blank\" rel=\"noopener nofollow\">Huddersfield Town<\/a> on Sunday, the players\u2019 clothing has been changed to \u2018Asahi 0.0%\u2019.<\/p>\n<div id=\"attachment_5189889\" class=\"wp-caption alignnone\">\n<div class=\"wp-caption-image-container\">\n<div class=\"inline-credits\">\n<div class=\"inline-credits-container\">\n      <span class=\"table-cell-span\"\/><br \/>\n      <span class=\"credits-text\">City wore training tops without the \u2018Super \u201cDry\u201d\u2019 branding at the weekend (Clive Brunskill\/Getty Images)<\/span><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>But with Superdry, the UK-based clothing brand, also seeking an injunction and financial damages, and even the option to \u2018destroy\u2019 City\u2019s \u2018Super \u201cDry\u201d\u2019-branded training gear, there will be more developments to come.<\/p>\n<p>Here, <em>The Athletic<\/em> explains what we know so far and what could come next.<\/p>\n<hr\/>\n<h2>What does Superdry want and why?<\/h2>\n<p>Superdry alleged City \u201cbenefit unfairly\u201d from \u201criding on the coattails of\u2026 well-known Superdry registrations\u201d and argues its own brand could be \u201ctarnished\u201d by poor quality clothing items sold by City.<\/p>\n<p>It also claims there is potential for its brand to be affected by \u201cnegative perceptions or preconceptions of Manchester City Football Club in the minds of e.g. supporters of rival football clubs\u201d and says the club\u2019s use of Super \u201cDry\u201d branding could do \u201cdamage to the reputation of Superdry\u201d.<\/p>\n<p>Superdry submitted that \u201cthe appearance of the (training) kit is liable to deceive a substantial number of members of the UK public into believing that the (training) kit is clothing designed or sold by (Superdry)\u201d.<\/p>\n<p>As a result, the brand is seeking financial reparations from City. It is \u201cpresently unable to quantify the exact financial value of this claim\u201d, according to the court documents, but intends those damages to \u201cinclude\u2026 any unfair profits made by the infringer by reason of the infringement\u201d.<\/p>\n<p>The value of City\u2019s training kit sponsorship with Asahi was not made available publicly, although it was reported the club\u2019s previous partner, OKX, paid $20million (\u00a318.5m) for the 2022-23 season and therefore speculated that the new agreement would fall in a similar bracket.<\/p>\n<div id=\"attachment_5189873\" of December (Alex Livesey\/Getty Images)<\/span><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>Superdry claims City have \u201cprofited very substantially\u201d from the sponsorship deal related to the branding on the training kit and that they have \u201cengaged in\u2026 infringing activities knowingly and\/or with reasonable grounds for knowing that Superdry was a well-known clothing brand\u201d that had not given its permission.<\/p>\n<p>In November 2023, Asahi won an award from marketing agency The Drum for a campaign which set out, according to an article on The Drum\u2019s website, to \u201celevate the status of the training kit and instil it with the same level of pride and symbolism as the first kit and away kit\u201d.<\/p>\n<p>Following acceptance of the award, Asahi said the campaign \u2014 which featured <a class=\"ath_autolink\" data-id=\"TX7pFeb0aiHzuvjI\" href=\"https:\/\/theathletic.com\/football\/player\/kevin-de-bruyne-TX7pFeb0aiHzuvjI\/\" target=\"_blank\" rel=\"noopener nofollow\">Kevin De Bruyne<\/a> and <a class=\"ath_autolink\" data-id=\"Qco6BKmHmB44RMjL\" href=\"https:\/\/theathletic.com\/football\/player\/john-stones-Qco6BKmHmB44RMjL\/\" target=\"_blank\" rel=\"noopener nofollow\">John Stones<\/a>, among others \u2014 was City\u2019s most-engaged-with piece of sponsorship content of the season up until that point, achieving 19.87million views and 428,000 interactions across social media.<\/p>\n<p>Superdry also asked the court to stop City from using or selling any items emblazoned with the phrase \u2018Super \u201cDry\u201d\u2019 and for the club to transfer to the company all such items, or to \u201cdestroy or modify\u201d them.<\/p>\n<h2>What else is in the court documents?<\/h2>\n<p>In documents submitted on December 15 \u2014 and seen by <em>The Athletic<\/em> \u2014 Superdry sets out to highlight its popularity as a brand, highlighting its 98 UK stores, several well-followed social media pages and awards won, as well as listing celebrities such as David Beckham, Neymar Jr and Kylie Jenner to have worn its clothing.<\/p>\n<p>It also cited collaborations with rock bands Metallica, the Sex Pistols, Iron Maiden and Motley Crue.<\/p>\n<p>City players <a class=\"ath_autolink\" data-id=\"s7XcWPajmHg12zuq\" href=\"https:\/\/theathletic.com\/football\/player\/julian-alvarez-s7XcWPajmHg12zuq\/\" target=\"_blank\" rel=\"noopener nofollow\">Julian Alvarez<\/a>, <a class=\"ath_autolink\" data-id=\"D9VhhPVj6LYzpmVZ\" href=\"https:\/\/theathletic.com\/football\/player\/jack-grealish-D9VhhPVj6LYzpmVZ\/\" target=\"_blank\" rel=\"noopener nofollow\">Jack Grealish<\/a>, <a class=\"ath_autolink\" data-id=\"UqdITFAwdmIrBQfd\" href=\"https:\/\/theathletic.com\/football\/player\/erling-haaland-UqdITFAwdmIrBQfd\/\" target=\"_blank\" rel=\"noopener nofollow\">Erling Haaland<\/a>, <a class=\"ath_autolink\" data-id=\"0ZTVFCfiA5I3chgf\" href=\"https:\/\/theathletic.com\/football\/player\/kyle-walker-0ZTVFCfiA5I3chgf\/\" target=\"_blank\" rel=\"noopener nofollow\">Kyle Walker<\/a> and <a class=\"ath_autolink\" data-id=\"7aDnfAZLpnuH4BtA\" href=\"https:\/\/theathletic.com\/football\/player\/oscar-bobb-7aDnfAZLpnuH4BtA\/\" target=\"_blank\" rel=\"noopener nofollow\">Oscar Bobb<\/a> are also shown wearing training gear emblazoned with Asahi\u2019s \u2018Super \u201cDry\u201d\u2019 branding, specifically \u2018Super \u201cDry\u201d Asahi 0.0%\u2019.<\/p>\n<p>Superdry argues some of the photos demonstrate that not all of that wording will always be visible due to \u201cvarious factors such as the viewing angle and the physical posture of the wearer\u201d. One of the photos does show Haaland inadvertently covering much of the \u201cAsahi\u201d logo on his training shirt.<\/p>\n<p>The brand also provides examples of its own clothing where the words \u2018Super\u2019 and \u2018Dry\u2019 are stacked on top of each other, as was the case on City\u2019s Asahi clothing.<\/p>\n<p>City already appear to have made changes to their training gear. Last Wednesday, the club posted a picture of women\u2019s team striker Khadija Shaw in training wearing a half-zip bearing the words \u201cAsahi 0.0%\u201d. On Thursday, there were further images of the male players wearing clothing with the same branding.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" rel=\"noopener nofollow\">January 3, 2024<\/a><\/p>\n<\/blockquote>\n<p>The last time the \u2018Super \u201cDry\u201d\u2019-branded items were publicly visible was during the <a class=\"ath_autolink\" data-id=\"6\" href=\"https:\/\/theathletic.com\/football\/premier-league\/\" target=\"_blank\" rel=\"noopener nofollow\">Premier League<\/a> match against <a class=\"ath_autolink\" data-id=\"681\" href=\"https:\/\/theathletic.com\/football\/team\/sheffield-united\/\" target=\"_blank\" rel=\"noopener nofollow\">Sheffield United<\/a> on December 30.<\/p>\n<p>City have not commented and it is not clear when they were made aware of the claim against them.<\/p>\n<h2>What are the implications for City?<\/h2>\n<p>City announced in July that beer brand Asahi Super \u201cDry\u201d would feature on both the men\u2019s and women\u2019s training gear throughout 2023-24.<\/p>\n<p>In a statement at the time, they said: \u201cSince the start of the partnership, the Asahi Super Dry brand has been integrated across a number of different areas, including the rebrand of the Asahi Super Dry Tunnel Club and wider installation of cutting-edge technology throughout the Etihad Stadium to provide City fans with the unique Japanese super dry taste.\u201d<\/p>\n<p>This claim relates only to training apparel rather than City\u2019s tunnel club hospitality offering.<\/p>\n<p>Although the Super \u201cDry\u201d brand itself belongs to Asahi \u2014 and is trademarked in relation to beer advertising rather than clothing \u2014 City find themselves in the middle of the claim because they own and were selling the product bearing the disputed wording.<\/p>\n<p>There is no set date for any further court hearings and it is unknown when there will be a resolution.<\/p>\n<p>Superdry, Asahi and
