{"id":16534,"date":"2024-01-19T15:30:54","date_gmt":"2024-01-19T20:30:54","guid":{"rendered":"https:\/\/newssprinters.com\/index.php\/world\/french-police-officer-convicted-in-theo-luhaka-abuse-case\/19\/01\/2024\/"},"modified":"2024-01-19T15:30:54","modified_gmt":"2024-01-19T20:30:54","slug":"french-police-officer-convicted-in-theo-luhaka-abuse-case","status":"publish","type":"post","link":"https:\/\/newssprinters.com\/index.php\/world\/french-police-officer-convicted-in-theo-luhaka-abuse-case\/19\/01\/2024\/","title":{"rendered":"French Police Officer Convicted in Th\u00e9o Luhaka Abuse Case"},"content":{"rendered":"<p>\n<\/p>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">A police officer who brutalized a 22-year-old Black man with an expandable baton during an arrest seven years ago was convicted by a French court on Friday of \u201cintentional violence\u201d in one of the country\u2019s highest-profile cases of police abuse.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The young man, Th\u00e9o Luhaka, sustained a four-inch tear to his rectum after the police subdued him during an identity check while he was cutting through a known drug-dealing zone in his housing project in a suburb northeast of Paris.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Two other officers who assisted in the arrest were also found guilty at the court in Bobigny, a suburb northeast of Paris, in a decision that was, however, unlikely to fully satisfy either police unions or anti-police brutality activists.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The officer who wielded the baton was sentenced to a one-year suspended prison sentence, meaning he will serve time only if he commits a new crime within a given time frame and a court then orders the full sentence to be served. The two other officers were sentenced to three-month suspended sentences. The sentences were less than what prosecutors had requested.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">They had all pleaded not guilty, stating that Mr. Luhaka had been violently resisting arrest and they were acting in self-defense, doing their jobs in hostile terrain and under stressful conditions and that the baton thrust had been aimed at the upper thigh and was a technique learned at the police academy.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The verdict, delivered rapidly after over nine hours of deliberation, capped a trial that came at a time when <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/01\/07\/world\/europe\/france-stabbing-romans-sur-isere.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">the issue of race in France<\/a>, and the policing of Black and Arab men in the country\u2019s impoverished suburbs, remains particularly sensitive.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe message that was passed is that we are not human beings. We are considered lesser beings,\u201d said Issa Diara, an activist, as he left the court in a crowd that was chanting for firm prison sentences against police and holding up posters with Mr. Luhaka\u2019s face on them.<\/p>\n<p class=\"css-at9mc1 evys1bk0\"><a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/06\/28\/world\/europe\/france-police-shooting-paris-nanterre.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">Violent protests<\/a> erupted across the country last summer after the police fatally shot Nahel Merzouk, a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/06\/29\/world\/europe\/france-riots-nahel-shooting.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">17-year-old French citizen of Algerian and Moroccan descent, during a morning traffic stop<\/a>. Mr. Merzouk had been driving a car without a license and had sped off after the police tried to stop him.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But long before then, the case of Mr. Luhaka, who had no criminal record, had been held up as a potent symbol of perceived racial discrimination by the police against men in minority communities, and the obstinate refusal of the authorities to address it over decades.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In the February 2017 incident, three officers wrestled Mr. Luhaka to the ground, hit him repeatedly and sprayed tear gas on his face. The violent encounter left him incontinent after two operations.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He told the court the incident had robbed him of his life and that he now spends his days depressed and cloistered to his room.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Similar to last summer\u2019s demonstrations over Mr. Merzouk\u2019s killing, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2017\/02\/08\/world\/europe\/fury-rises-in-france-over-accusations-police-beat-and-raped-a-black-man.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">the police attack on Mr. Luhaka ignited riotous protests over days<\/a>, though they were mostly confined to the suburb of Aulnay-sur-Bois, where Mr. Luhaka continues to live.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">At the time of his arrest, there was a sense that the case of Mr. Luhaka might actually prove a turning point for France, causing a change in the relationship between the country\u2019s centralized police force and its minority populations. President Fran\u00e7ois Hollande visited Mr. Luhaka in the hospital and praised him for \u201cexemplary conduct.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Emmanuel Macron, at the time a presidential candidate in an election he would win months later, pledged to transform the police system into one more tailored to neighborhoods, so that officers could recognize local residents and \u201crebuild trust.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Instead, seven years later, there are numerous signs that things have gotten worse.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A <a class=\"css-yywogo\" href=\"https:\/\/www.defenseurdesdroits.fr\/sites\/default\/files\/atoms\/files\/rapport-enquete_relations_police_population-20170111_1.pdf\" title=\"\" rel=\"noopener\" target=\"_blank\">2017 investigation<\/a> by the country\u2019s civil liberties ombudsman found that \u201cyoung men perceived to be Black or Arab\u201d were 20 times as likely to be subjected to police identity checks than the rest of the population.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">French courts <a class=\"css-yywogo\" href=\"https:\/\/www.lemonde.fr\/police-justice\/article\/2016\/11\/09\/controles-au-facies-la-cour-de-cassation-condamne-l-etat_5028213_1653578.html\" title=\"\" rel=\"noopener\" target=\"_blank\">have<\/a> <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2021\/06\/09\/world\/europe\/france-racial-profiling-police-court.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">faulted<\/a> the government twice for discriminatory police checks. Last fall, France\u2019s highest administrative court <a class=\"css-yywogo\" href=\"https:\/\/www.theguardian.com\/world\/2023\/oct\/11\/court-police-france-racial-profiling-identity-checks-discriminatory\" title=\"\" rel=\"noopener\" target=\"_blank\">ruled that the police often commit racial profiling in these stops<\/a>, but deemed it was not within its jurisdiction to force new rules to end the practice.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The federal authorities have long rebutted accusations of systemic racism within the police force, calling them \u201c<a class=\"css-yywogo\" href=\"https:\/\/www.diplomatie.gouv.fr\/fr\/politique-etrangere-de-la-france\/la-france-et-les-nations-unies\/evenements-et-actualites-lies-aux-nations-unies\/actualites\/article\/declaration-de-la-porte-parole-du-haut-commissariat-des-nations-unies-aux\" title=\"\" rel=\"noopener\" target=\"_blank\">totally unfounded<\/a>\u201d last year in response to criticism from the United Nations High Commissioner for Human Rights. One of the French state\u2019s founding ideals is that all citizens share the same universal rights and are treated equally, regardless of religion or race.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In the country\u2019s centralized police system, it is rare for a police officer to be criminally charged for excessive use of force, even when lethal, during an arrest \u2014 an issue that has been raised by international human rights groups for decades. In the few cases sent to criminal courts, often many years later, convictions are infrequent and sentences considered mainly nominal.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Fabien Goa, an Amnesty International researcher based in Marseille, <a class=\"css-yywogo\" href=\"https:\/\/www.amnesty.org\/en\/documents\/eur21\/001\/2005\/en\/\" title=\"\" rel=\"noopener\" target=\"_blank\">cited a 2005 report<\/a> by his organization that described \u201ca climate of effective impunity for law enforcement officials\u201d in France and said little has changed since then.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cThat kind of condemnation should trigger a serious political mobilization to ensure that the rule of law is respected,\u201d he said. \u201cAnd if you look from 2005 to now, I think you can say that the seriousness of the situation has not been met with political will.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The three officers who were sentenced for the arrest of Mr. Luhaka faced no internal disciplinary sanctions and have continued to work.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The enduring sense of mistrust and anger of police over violent interactions with citizens of minority backgrounds, including the attack on Mr. Luhaka, exploded back into public view last summer after the shooting of Mr. Merzouk.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Initial reports of the shooting in the French news media, citing what were described as anonymous police sources, said the teenager had driven into the two officers on the scene. <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/06\/28\/world\/europe\/france-police-shooting-paris-nanterre.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">But a bystander\u2019s video of the shooting that went viral on social media showed the opposite<\/a>: the officer who fired the shot was not in any immediate danger, and was at the side of the car as it was pulling away.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Over the ensuing days, young men \u2014 some as young as 12 years old \u2014 <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/07\/01\/world\/europe\/paris-shooting-protests-violence.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">caused havoc across the country<\/a>, burning cars, setting fire to buildings, vandalizing police stations and looting businesses.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\"><a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/07\/04\/france-riots-arrests-police-shooting.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">Thousands were arrested and convicted in hasty trials<\/a>. The French Insurers Federation <a class=\"css-yywogo\" href=\"https:\/\/www.franceassureurs.fr\/espace-presse\/les-communiques-de-presse\/cout-sinistres-declares-violences-urbains-fin-juin-reevalue-730millions-euros\/\" title=\"\" rel=\"noopener\" target=\"_blank\">claimed<\/a> 730 million euros, or $794 million, in damages. A preliminary <a class=\"css-yywogo\" href=\"https:\/\/www.justice.gouv.fr\/sites\/default\/files\/2023-09\/rapport_definitif_violences_urbaines_2023.pdf\" title=\"\" rel=\"noopener\" target=\"_blank\">government report<\/a> released later found that much of the looting and destruction was opportunistic.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In response to the shooting, two online fund-raisers were launched \u2014 one for the mother of the teenager, who had raised him on her own, and the other for the wife of the police officer who was charged with voluntary homicide.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The two made for an unofficial barometer of sentiment in the country.
