It will now return to the House of Representatives for final approval.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The new bill, which is expected to pass in the House with ease, will let Australian workers refuse \u201cunreasonable\u201d professional communication outside of the workday. Workplaces that punish employees for not responding to such demands could be fined.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cSomeone who is not being paid 24 hours a day shouldn\u2019t be penalized if they\u2019re not online and available 24 hours a day,\u201d Prime Minister Anthony Albanese said at a news conference on Wednesday.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The provision is a last-minute amendment to a package of proposed legal changes aimed at strengthening workers\u2019 rights. The legislation, which also includes protections for temporary workers looking to become more permanent, and new standards for gig workers, such as food delivery drivers, had been heavily debated.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Australia follows in the footsteps of European nations such as France, which <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2017\/01\/02\/world\/europe\/france-work-email.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">in 2017<\/a> introduced the right of workers to disconnect from employers while off duty, a move later emulated by Germany, Italy and Belgium. The European Parliament <a class=\"css-yywogo\" href=\"https:\/\/multimedia.europarl.europa.eu\/en\/video\/the-right-to-disconnect-from-work_N01-AFPS-210119-RTDI\" title=\"\" rel=\"noopener\" target=\"_blank\">has also called<\/a> for a law across the bloc that would alleviate the pressure on workers to answer communications off the clock.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe world is connected, but that has created a problem,\u201d Tony Burke, the minister for employment and workplace relations, said in an <a class=\"css-yywogo\" href=\"https:\/\/ministers.dewr.gov.au\/burke\/interview-patricia-karvelas-abc-rn\" title=\"\" rel=\"noopener\" target=\"_blank\">interview<\/a> with Australia\u2019s public broadcaster on Tuesday.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cIf you\u2019re in a job where you\u2019re only paid for the exact hours that you\u2019re working, some people are now constantly in a situation of getting in trouble if they\u2019re not checking their emails,\u201d Mr. Burke added. It was reasonable for employers to contact their workers about shifts and other matters, he said, but workers should not be obligated to respond to these messages during their uncompensated hours.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Unions and other industrial groups have long argued that employees have the right to disconnect, but the issue gained salience during the pandemic, when a widespread shift to remote work led to the further blurring of boundaries between home life and work life.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Critics of the new rule, among them businesses groups and opposition lawmakers, have called it <a class=\"css-yywogo\" href=\"https:\/\/www.bca.com.au\/government_should_adopt_crossbench_changes_and_consult_on_rushed_right_to_disconnect_proposal\" title=\"\" rel=\"noopener\" target=\"_blank\">rushed<\/a> and an overreach from the government, expressing concerns that it could make it harder for businesses to get their work done.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThis legislation will create significant costs for businesses and result in less jobs and less opportunities,\u201d Bran Black, the chief executive of the Business Council of Australia, said in a statement.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cNone of the measures are designed to improve productivity, jobs, growth and investment, which are the ingredients of a successful economy,\u201d said Michaelia Cash, a senator from the right-wing opposition Liberal Party. She added: \u201cWorkers already have legal protections against unreasonable working hours.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Others criticized the mechanism of the legislation, which places the onus on workers to protect their rights rather than obliging employers to not contact staff members at unreasonable hours.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Similar orders, said Kevin Jones, an Australian workplace safety expert, \u201care usually used by someone who realizes that their relationship with their employer is now so tainted, that it\u2019s not functional and they may as well leave.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Australians already enjoy a host of standardized benefits, including 20 days of paid annual leave, mandatory paid sick leave, \u201clong service\u201d leave of six weeks for those who have remained at an employer for at least seven years, 18 weeks of paid maternity leave and a nationwide minimum wage of about $15 an hour.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The country <a class=\"css-yywogo\" href=\"https:\/\/remote.com\/resources\/research\/global-life-work-balance-index\" title=\"\" rel=\"noopener\" target=\"_blank\">ranks fourth in the world<\/a> for \u201cwork-life balance,\u201d behind New Zealand, Spain and France, according to an index from the global employment platform Remote.
