{"id":2050,"date":"2023-10-09T03:05:42","date_gmt":"2023-10-09T07:05:42","guid":{"rendered":"https:\/\/newssprinters.com\/index.php\/world\/what-to-know-as-the-u-k-appeals-a-ruling-on-its-asylum-policy\/09\/10\/2023\/"},"modified":"2023-10-09T03:05:42","modified_gmt":"2023-10-09T07:05:42","slug":"what-to-know-as-the-u-k-appeals-a-ruling-on-its-asylum-policy","status":"publish","type":"post","link":"https:\/\/newssprinters.com\/index.php\/world\/what-to-know-as-the-u-k-appeals-a-ruling-on-its-asylum-policy\/09\/10\/2023\/","title":{"rendered":"What to Know as the U.K. Appeals a Ruling on Its Asylum Policy"},"content":{"rendered":"<p>\n<\/p>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">On Monday, the British government begins its appeal of <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/06\/29\/world\/europe\/uk-rwanda-migrants-unlawful.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">a Supreme Court decision<\/a> that determined a policy to deport asylum seekers to Rwanda was unlawful, opening the latest chapter in a legal saga that has played out since the highly contentious plan was announced in 2022.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The policy, which Britain\u2019s Conservative government has maintained would act as a deterrent to the dangerous boat crossings made by thousands of asylum seekers across the English Channel, would allow the government to send anyone arriving by these types of irregular means to Rwanda.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The plan has been repeatedly challenged by rights groups, so far halting any planned deportations. Here\u2019s what to know as the new appeal gets underway.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<h2 class=\"css-9ycfei eoo0vm40\" id=\"link-9a3a089\">The Rwanda policy was first announced last year.<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">The policy was first announced by Priti Patel, then the home secretary, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/04\/15\/world\/europe\/britain-rwanda-asylum-explained.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">in April 2022<\/a> in partnership with Rwanda. It planned for people arriving in Britain by \u201cillegal, dangerous or unnecessary methods,\u201d such as on small boats that cross the English Channel, to be deported to Rwanda to have their asylum processed there.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In return, the British government would invest tens of millions in the central African nation. In the months since, the government has repeatedly vowed to implement the policy, despite widespread criticism, heralding it as a deterrent to asylum seekers attempting to travel to Britain.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">On Friday, ahead of the appeal being heard in the Supreme Court, a spokesperson for the Home Office said that while it awaits the decision, earlier judgments made the government \u201cconfident in our case.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIllegal migration is a complex, global issue, and one which requires fresh solutions,\u201d the spokesperson said. \u201cOur Migration Partnership with Rwanda offers just that, and we are ready to defend it in the courts.\u201d<\/p>\n<h2 class=\"css-9ycfei eoo0vm40\" id=\"link-48e16d9a\">The Supreme Court ruled in June that the policy is unlawful.<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">The policy faced a number of legal challenges before making its way to the Supreme Court earlier this year. This appeal is to a case involving claims brought by five asylum seekers from Syria, Sudan, Vietnam and Iran who traveled to Britain in small boats \u2014 and, in one instance, by truck \u2014 and were informed that they would be sent to Rwanda.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">They challenged the legality of the plan, and the Supreme Court\u2019s June judgment, which reversed an earlier decision by the High Court, was seen as a major victory by rights groups. The government swiftly announced plans to challenge the Supreme Court decision, and that appeal is being heard this week.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">It could be weeks or months before a decision is announced. But rights groups; <a class=\"css-yywogo\" href=\"https:\/\/www.unhcr.org\/news\/news-releases\/un-refugee-agency-opposes-uk-plan-export-asylum\" title=\"\" rel=\"noopener\" target=\"_blank\">the U.N. refugee agency, U.N.H.C.R<\/a>.; and opposition politicians have denounced the policy from its inception, and many have vowed to continue to fight it through all available means.<\/p>\n<h2 class=\"css-9ycfei eoo0vm40\" id=\"link-2c6babad\">So far, no one has been sent to Rwanda under the plan.<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">But the British government paid the Rwandan government at least \u00a3140 million \u2014 or more than $170 million \u2014 last year alone as part of the arrangement, <a class=\"css-yywogo\" href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/1185849\/Home_Office_Annual_Report_and_Accounts_22-23.pdf\" title=\"\" rel=\"noopener\" target=\"_blank\">according to the Home Office\u2019s annual report.<\/a> And despite the June ruling that the plan was unlawful, asylum seekers in Britain are still receiving notices that they are to be deported.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Rights groups say the policy violates international law, and many have argued that Rwanda\u2019s <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/10\/09\/world\/africa\/migration-crisis-rwanda.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">troubled human rights record makes it unsuitable for asylum seekers.<\/a><\/p>\n<p class=\"css-at9mc1 evys1bk0\">Steve Smith, the chief executive of the British charity Care4Calais, which supports refugees and brought an earlier legal challenge against the policy, said in a written statement that the \u201cdeficiencies in Rwanda\u2019s asylum system\u201d that the court based its June ruling on \u201ccannot be wished away.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Gillian Triggs, U.N.H.C.R.\u2019s assistant high commissioner for protection, <a class=\"css-yywogo\" href=\"https:\/\/www.unhcr.org\/news\/news-releases\/un-refugee-agency-opposes-uk-plan-export-asylum\" title=\"\" rel=\"noopener\" target=\"_blank\">said in a statement last year<\/a> that the organization was \u201cfirmly opposed to arrangements that seek to transfer refugees and asylum seekers to third countries in the absence of sufficient safeguards.\u201d<\/p>\n<h2 class=\"css-9ycfei eoo0vm40\" id=\"link-8c78ab6\">The government says the policy is key to stopping small boat arrivals.<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">The plan is part of a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/03\/07\/world\/europe\/uk-migration-asylum.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">package of measures that includes the Illegal Migration Bill<\/a> that makes way for a number of changes for asylum seekers in Britain.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The bill, which has passed through Parliament and will soon become law, declares that anyone who arrives in Britain through \u201cillegal\u201d means will have their asylum claim deemed \u201cinadmissible.\u201d The bill makes provisions for them to be detained indefinitely and then removed either to their home country or a \u201csafe third country.\u201d This is where the Rwanda plan would come in.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Small boat arrivals make up less than half of all asylum claims. In 2022, <a class=\"css-yywogo\" href=\"https:\/\/www.gov.uk\/government\/statistics\/irregular-migration-to-the-uk-year-ending-december-2022\" title=\"\" rel=\"noopener\" target=\"_blank\">government data shows<\/a>, 40,302 asylum claims were made by people who arrived in small boats out of a total of 89,398 total applications<a class=\"css-yywogo\" href=\"https:\/\/www.gov.uk\/government\/statistics\/irregular-migration-to-the-uk-year-ending-december-2022\/https:\/\/www.gov.uk\/government\/statistics\/irregular-migration-to-the-uk-year-ending-december-2022\/irregular-migration-to-the-uk-year-ending-december-2022#how-many-migrants-were-detected-arriving-in-the-uk-via-small-boats\" title=\"\" rel=\"noopener\" target=\"_blank\">.<\/a> An <a class=\"css-yywogo\" href=\"https:\/\/www.refugeecouncil.org.uk\/wp-content\/uploads\/2023\/01\/Refugee-Council-Channel-Crossings-briefing-March-2023.pdf\" title=\"\" rel=\"noopener\" target=\"_blank\">analysis of that data by the Refugee Council<\/a> showed that two-thirds of those who arrived last year would most likely have their asylum applications approved and be permitted to stay in Britain.<\/p>\n<h2 class=\"css-9ycfei eoo0vm40\" id=\"link-29ef1a76\">Migration has become increasingly politicized.<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">Ahead of an expected general election next year, the governing Conservative Party has ramped up a policy toward migrants and asylum seekers that has long been described by rights groups as hostile, introducing the Illegal Migration Bill and using hotels, barges and former military bases to house asylum seekers.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Britain\u2019s current home secretary, Suella Braverman, has been the source of some of the harshest rhetoric. In 2022, she told the Conservative Party\u2019s annual conference that it was her \u201cdream\u201d to see a flight depart for Rwanda, and after the Supreme Court decision earlier this summer, she vowed to do <a class=\"css-yywogo\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-66051292\" title=\"\" rel=\"noopener\" target=\"_blank\">\u201cwhatever it takes\u201d to see the policy put in place<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Like her predecessor, Ms. Braverman has toured potential housing for asylum seekers in Rwanda, and she has reiterated her party\u2019s stance that the plan \u201cwill act as a powerful deterrent.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The opposition Labour Party has denounced the plan, calling the policy unethical.
