When Ye and Ty Dolla Sign asked last month for permission to sample Donna Summer\u2019s 1977 song \u201cI Feel Love,\u201d the disco singer\u2019s estate firmly told them no. Yet when their joint LP, \u201cVultures 1,\u201d was released weeks ago, a song with strong similarities to Summer\u2019s famous tune<\/a> was there on the track list.<\/p>\n A copyright infringement lawsuit detailing that timeline was filed against Ye, the rapper once known as Kanye West, and Ty Dolla Sign on Tuesday by Summer\u2019s husband and executor, Bruce Sudano. Summer, known as the \u201cQueen of Disco,\u201d had three consecutive double albums reach No. 1 in the late 1970s and died of cancer in 2012<\/a>.<\/p>\n The lawsuit, filed in federal court in Los Angeles, said that Summer\u2019s estate \u201cwanted no association with West\u2019s controversial history.\u201d<\/p>\n Ye, once one of the biggest music stars on the planet, lost professional associations with the Creative Artists Agency and Adidas in 2022 after he threatened in an online post to go \u201cdeath con 3 On JEWISH PEOPLE,\u201d among other antisemitic statements<\/a>. He has apologized in a Hebrew-language social media post<\/a>.<\/p>\n<\/div>\n<\/div>\n The \u201cVultures 1\u201d song in question, \u201cGood (Don\u2019t Die),\u201d was played at a listening party at an arena on Long Island<\/a> on Feb. 9 and was initially released on the album the next day, but has since been removed from it by most online music services.<\/p>\n The lawsuit by Summer\u2019s estate said Ye and Ty Dolla Sign had \u201crecorded almost verbatim the key, memorable portions of Summer\u2019s iconic song, used it as the hook for their own song, and released it to the public knowing they had tried and failed to secure legal permission from its rightful owners.\u201d<\/p>\n A representative for Ye and Ty Dolla Sign did not immediately reply to a request for comment.<\/p>\n The Summer song was not the only contested sample on Ye\u2019s latest album. In a social media post this month<\/a>, Ozzy Osbourne said Ye had wrongfully used a sample from a 1983 live performance of the Black Sabbath hit \u201cIron Man\u201d on a song heard at a listening party.<\/p>\n Osbourne said he had denied a sample request from the rapper \u201cbecause he is an antisemite and has caused untold heartache.\u201d<\/p>\n On \u201cVultures 1,\u201d that sample was replaced<\/a> with one from Ye\u2019s 2010 track \u201cHell of a Life,\u201d which samples \u201cIron Man\u201d and on which Osbourne is a credited writer.<\/p>\n<\/div>\n<\/div>\n
