{"id":22863,"date":"2024-03-04T13:45:09","date_gmt":"2024-03-04T18:45:09","guid":{"rendered":"https:\/\/newssprinters.com\/index.php\/world\/french-lawmakers-enshrine-access-to-abortion-in-constitution\/04\/03\/2024\/"},"modified":"2024-03-04T13:45:09","modified_gmt":"2024-03-04T18:45:09","slug":"french-lawmakers-enshrine-access-to-abortion-in-constitution","status":"publish","type":"post","link":"https:\/\/newssprinters.com\/index.php\/world\/french-lawmakers-enshrine-access-to-abortion-in-constitution\/04\/03\/2024\/","title":{"rendered":"French Lawmakers Enshrine Access to Abortion in Constitution"},"content":{"rendered":"<p>\n<\/p>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">French legislators on Monday voted to explicitly enshrine access to abortion in the Constitution, making their country the first in the world to do so.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Acutely aware that they were breaking historical ground from the grand assembly room inside Versailles Palace, the politicians delivered impassioned speeches about women\u2019s rights around the world, paid homage to the courageous Frenchwomen who had fought for abortion rights when it was illegal and leaped up time and again to offer standing ovations.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cWe are sending the message to all women: Your body belongs to you and no one has the right to control it in your stead,\u201d Prime Minister Gabriel Attal said before the gathered lawmakers voted 780-72 for the amendment.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The amendment declares abortion to be a \u201cguaranteed freedom,\u201d overseen by Parliament\u2019s laws. That means future governments will not be able to \u201cdrastically modify\u201d the current laws funding abortion for women who seek it, up to 14 weeks into their pregnancies, according to the French justice minister, \u00c9ric Dupond-Moretti.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Amending the Constitution is not unprecedented in France; the current Constitution has been modified over 20 times since it was adopted in 1958. But it is rare. Lawmakers last amended the Constitution in 2008.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The impulse for the latest change was the decision by the U.S. Supreme Court to overturn <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/06\/24\/us\/roe-wade-overturned-supreme-court.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">Roe v. Wade<\/a> in 2022, an issue raised repeatedly by legislators. But the move also reflects the widespread support for abortion in France, and a successful campaign by a coalition of feminist activists and lawmakers from multiple parties.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cFrance is showing the right to abortion is no longer an option, it\u2019s a condition of our democracy,\u201d said M\u00e9lanie Vogel, a Green Party senator who has been a major force behind the bill. \u201cThe French Republic will no longer remain democratic without the right to abortion.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Ms. Vogel said in an interview, \u201cI want to send a message to feminists outside of France. Everyone told me a year ago it was impossible.\u201d She added: \u201cNothing is impossible when you mobilize society.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The Conference of Bishops, representing the Catholic Church in France, <a class=\"css-yywogo\" href=\"https:\/\/eglise.catholique.fr\/espace-presse\/communiques-de-presse\/546547-vote-par-le-senat-de-linscription-du-droit-a-livg-dans-la-constitution-declaration-de-la-cef-2\/\" title=\"\" rel=\"noopener\" target=\"_blank\">opposed the amendment<\/a>. But in France, a country where calls to protest regularly bring hundreds of thousands to the streets, the opposition was notably scarce.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">With the vote, France became the first country in the world to explicitly write access to abortion into its Constitution, according to five constitutional experts.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIt\u2019s not stating reproductive choices or the right to have children; it\u2019s a very different language when you say access to abortion,\u201d said Anna Sledzinska-Simon, a professor of comparative constitutions and human rights law at the University of Wroclaw in Poland. \u201cThe French are calling it by its name \u2014 that\u2019s crucial.\u201d She added: \u201cThe whole world is watching.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Constitutional experts say the amendment broadens the mold of France\u2019s fundamental text, written by men for men while ignoring their dependence on women.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cIt\u2019s a big milestone, because it goes to the very foundation of this idea that constitutions were about men\u2019s autonomy,\u201d said Ruth Rubio-Mar\u00edn, <a class=\"css-yywogo\" href=\"https:\/\/cadmus.eui.eu\/handle\/1814\/74993\" title=\"\" rel=\"noopener\" target=\"_blank\">author of a book on gender and constitutions<\/a>. \u201cWomen\u2019s role as citizens was essentialized and defined as being breeders and caretakers,\u201d she said. \u201cThat was left out. It was just simply assumed as part of this modern society that was being built.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Other constitutions, particularly those of younger democracies such as Ecuador, have been broadened to include things like support for caregiving and the equal division of domestic work. But they often remain more aspirational than actionable, said Ms. Rubio-Mar\u00edn, who teaches constitutional law at the University of Seville in Spain.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThat this is happening in the old world, in an established democracy where the constitution is taken seriously \u2014 in that way, it\u2019s historic,\u201d she said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The fight for legal abortion in France burst into public view in 1971, when 343 French women signed a manifesto written by the French feminist Simone de Beauvoir declaring that they had undertaken clandestine, illegal abortions and demanding that the law change.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Four years later, a female minister, Simone Veil, successfully pushed <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/1974\/11\/29\/archives\/legalabortion-bill-advances-in-france-after-heater-debate.html?timespastHighlight=Simone,Veil,and,abortion\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">through<\/a> a temporary law decriminalizing abortions and offering limited access to health services to terminate pregnancies.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Throughout the special legislative session on Monday, lawmakers paid tribute to Ms. Veil, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2018\/07\/01\/world\/europe\/simone-veil-pantheon-burial.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">a Holocaust survivor and human rights champion<\/a>, as well as Gis\u00e8le Halimi, the former lawyer whose defense of a 16-year-old student who had had an illegal abortion after having been raped led to her acquittal in 1972. The case was a turning point on the road to the legalization of abortion.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cWe have followed in your footsteps and like you, we succeeded,\u201d said Senator Laurence Rossignol, a former women\u2019s rights minister. She added that French feminists would continue to fight internationally against \u201cthose who resist,\u201d citing politicians including Donald J. Trump and President Vladimir V. Putin of Russia.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cLiberty, equality, fraternity,\u201d she said, citing the French national motto. \u201cAnd, if I could add, sorority.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Over the past five decades, the law assuring abortion rights has continually been expanded, to the point that it is now considered among the most liberal in Europe. It includes the right to fully funded abortions for women and minors up to the 14th week of pregnancy upon request, with no waiting period or required counseling sessions.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Later abortions are permitted if the pregnancy is deemed a risk to the woman\u2019s physical or psychological health or if the fetus presents certain anomalies.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">After the Covid pandemic hit, France quickly ensured that women seeking abortions could receive medical consultations virtually, said Laura Rahm, a researcher at Central European University, in Vienna, who examined access to abortion in France for a five-year <a class=\"css-yywogo\" href=\"https:\/\/europeabortionaccessproject.org\/\" title=\"\" rel=\"noopener\" target=\"_blank\">European study<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cA system always shines or cracks when it\u2019s put under pressure,\u201d she said. The French system had clearly shone, she said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Still, <a class=\"css-yywogo\" href=\"https:\/\/drees.solidarites-sante.gouv.fr\/sites\/default\/files\/2023-09\/ER1281MAJ.pdf\" title=\"\" rel=\"noopener\" target=\"_blank\">studies<\/a> show that 17 percent of women travel outside their home regions \u2014 called departments in France \u2014 for abortion services, sometimes because of <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2021\/08\/28\/world\/europe\/france-doctor-shortage-health-care-rural.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">a growing shortage of medical facilities locally<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">And though the law states that women should have a choice of medical or surgical abortions, in practice that\u2019s often not the case, said Sarah Durocher, national co-president of Le Planning Familial, a French equivalent of Planned Parenthood.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Putting the \u201cguaranteed freedom\u201d to have an abortion in the Constitution means that will have to change, she said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThis will give birth to other things,\u201d said Ms. Durocher, noting that 130 centers offering abortion had closed in France over the past decade. \u201cFor example, real policies so there is effective access to abortion.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Despite the new amendment, French feminists say that France remains a male-dominated society where <a class=\"css-yywogo\" href=\"https:\/\/www.liberation.fr\/societe\/droits-des-femmes\/le-haut-conseil-a-legalite-appelle-a-une-action-forte-des-pouvoirs-publics-contre-le-sexisme-20240122_OIOVMWNX7FHETPJBQIXXCTV4F4\/?redirected=1\" title=\"\" rel=\"noopener\" target=\"_blank\">sexism persists<\/a>. Settling into her perch overseeing the session as the president of the National Assembly, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/11\/22\/world\/europe\/france-antisemitism-braun-pivet.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">Ya\u00ebl Braun-Pivet<\/a> pointed out that she was the first woman in French history to preside over such a gathering.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But unlike in the United States, the issue of abortion in France is not politically charged and highly divisive. Instead, most French people believe abortion is a basic public health service and a woman\u2019s right. A recent <a class=\"css-yywogo\" href=\"https:\/\/www.ipsos.com\/en\/global-views-abortion#:~:text=How%20people%20feel%20about%20abortion,11%25%20illegal%20in%20all%20cases.\" title=\"\" rel=\"noopener\" target=\"_blank\">29-country survey<\/a> showed France having the second-highest support for legalized abortion in the world, after Sweden.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">However, attempts to introduce abortion into the Constitution had failed before the U.S. Supreme Court\u2019s decision to overturn <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/06\/24\/us\/roe-wade-overturned-supreme-court.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">Roe v. Wade<\/a>. The decision motivated French lawmakers to safeguard the practice, presenting multiple bills within months.
