He was 82.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">His publicist, Matt Lee, said the cause of his death, in a hospital, was congestive heart failure.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">As the leader of the White Panther Party in the late 1960s, Mr. Sinclair spoke of assembling a \u201cguitar army\u201d to wage \u201ctotal assault\u201d on racists, capitalism and the criminalization of marijuana. \u201cWe are a whole new people with a whole new vision of the world,\u201d he wrote in his book \u201cGuitar Army\u201d (1972), \u201ca vision which is diametrically opposed to the blind greed and control which have driven our immediate predecessors in Euro-Amerika to try to gobble up the whole planet and turn it into one big supermarket.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He also managed the incendiary Detroit rock band the MC5. Their lyrics \u2014 \u201cI\u2019m sick and tired of paying these dues\/And I\u2019m finally getting hip to the American ruse\u201d \u2014 were a kind of ballad for the cause.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sinclair\u2019s command of this \u201craggedy horde of holy barbarians,\u201d as he described them in his book, was upended in 1969 when Judge Robert J. Colombo of Detroit Recorder\u2019s Court sentenced him to nine and a half to 10 years in prison for giving two joints to an undercover police officer.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">During the hearing, Mr. Sinclair <a class=\"css-yywogo\" href=\"https:\/\/aadl.org\/node\/194074\" title=\"\" rel=\"noopener\" target=\"_blank\">argued<\/a> that he had been framed.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cEveryone who is taking part in this is guilty of violating the United States Constitution and violating my rights and everyone else that\u2019s concerned,\u201d he said. He added, \u201cThere is nothing just about this, there is nothing just about these courts, nothing just about these vultures over here.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In prison, he was responsible for folding underwear but spent most of his time reading and writing. \u201cThis is the best thing that\u2019s ever happened to me or our organization,\u201d he told Big Fat magazine during his incarceration. Asked why, he said, \u201cIt exposes the fascists who put me here.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sinclair\u2019s case became a cause c\u00e9l\u00e8bre in the counterculture movement. On Dec. 10, 1971, 15,000 supporters attended a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/1971\/12\/12\/archives\/15000-attend-michigan-u-rally-to-protest-jailing-of-radical-poet.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">rally and concert<\/a> at Crisler Arena in Ann Arbor, Mich. They brought a lot of marijuana with them.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cPeople were not only smoking joints openly and passing them around,\u201d Keith Stroup, the founder of the marijuana advocacy group NORML (the National Organization for the Reform of Marijuana Laws), <a class=\"css-yywogo\" href=\"https:\/\/norml.org\/blog\/2020\/07\/24\/a-founder-looks-at-50-the-free-john-sinclair-rally-public-protests-sometimes-matter\/\" title=\"\" rel=\"noopener\" target=\"_blank\">wrote<\/a>, \u201cbut several people, including one sitting near my seat, had quantities of marijuana sitting open on their laps, freely rolling joint after joint, to make sure everyone who attended could get high for the occasion.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sinclair spoke to the audience from prison over a phone line connected to the arena\u2019s speaker system.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cSay something to me,\u201d he said, and the crowd shouted, \u201cFree John!\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Among the musicians who performed were Stevie Wonder and Bob Seger. <a class=\"css-yywogo\" href=\"https:\/\/archive.nytimes.com\/www.nytimes.com\/books\/01\/04\/08\/specials\/ginsberg-obit.html?oref=login\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">Allen Ginsberg<\/a> and <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/1989\/04\/14\/obituaries\/abbie-hoffman-60-s-icon-dies-yippie-movement-founder-was-52.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">Abbie Hoffman<\/a> spoke, along with Bobby Seale, a founder of the Black Panther Party. The event was supposed to end at midnight, but it kept going, and at around 3 a.m. <a class=\"css-yywogo\" href=\"https:\/\/archive.nytimes.com\/www.nytimes.com\/library\/arts\/120980lennon-obit.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">Mr. Lennon<\/a> and Ms. Ono appeared onstage. The audience went berserk.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">With the antiwar activist Jerry Rubin playing drum in the background, Mr. Lennon and Ms. Ono performed a <a class=\"css-yywogo\" href=\"https:\/\/www.youtube.com\/watch?v=Qx1og_HqyBk\" title=\"\" rel=\"noopener\" target=\"_blank\">song<\/a> they had written for Mr. Sinclair. It began:<\/p>\n<p class=\"css-at9mc1 evys1bk0\"><em class=\"css-2fg4z9 e1gzwzxm0\">It ain\u2019t fair, John Sinclair<\/em><br \/><em class=\"css-2fg4z9 e1gzwzxm0\">In the stir for breathin\u2019 air<\/em><br \/><em class=\"css-2fg4z9 e1gzwzxm0\">Won\u2019t you care for John Sinclair?<\/em><br \/><em class=\"css-2fg4z9 e1gzwzxm0\">In the stir for breathin\u2019 air<\/em><br \/><em class=\"css-2fg4z9 e1gzwzxm0\">Let him be, set him free<\/em><br \/><em class=\"css-2fg4z9 e1gzwzxm0\">Let him be like you and me.<\/em><\/p>\n<p class=\"css-at9mc1 evys1bk0\">A few days later, the Michigan Supreme Court announced that it was reviewing the case. Mr. Sinclair was released on bond. The court later overturned the conviction.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Justice John B. Swainson held that Mr. Sinclair had been entrapped by Detroit police officers. Two other justices, Thomas E. Brennan and Paul L. Adams, wrote that Mr. Sinclair\u2019s sentence was \u201ccruel and unusual punishment in light of the case against him.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cToday is a great victory,\u201d Mr. Sinclair <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/1972\/03\/12\/archives\/freed-poet-hails-michigan-ruling-sees-victory-in-reversal-of.html?timespastHighlight=John,Sinclair\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">said<\/a> at a news conference, puffing on a joint.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">John Alexander Sinclair Jr. was born on Oct. 2, 1941, in Flint, Mich. His father worked for Buick Motors, first on the assembly line and later in management. His mother, Elsie (Newberry) Sinclair, was a teacher. The family lived in Davison, a small town near Flint.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cI grew up there on Lapeer Street, the last street in town going east, and there were fields and woods out beyond our backyard where all the kids on the block spent a lot of time,\u201d he wrote in \u201cGuitar Army.\u201d \u201cThey\u2019ve got subdivisions out there now, of course, but then they\u2019ve got a big \u2018marijuana problem\u2019 in Davison now, too, which just goes to show you.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He graduated from the University of Michigan in 1964 with a bachelor\u2019s degree in American literature. He pursued a master\u2019s degree in English literature at Wayne State University in Detroit, but he was expelled \u201cbecause I was a dope fiend,\u201d he <a class=\"css-yywogo\" href=\"https:\/\/www.freep.com\/story\/entertainment\/music\/2024\/04\/02\/john-sinclair-detroit-poet-cannabis-activist-and-counterculture-icon-dead-at-82\/73179306007\/\" title=\"\" rel=\"noopener\" target=\"_blank\">told<\/a> The Detroit Free Press.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sinclair stayed in the city. He wrote poetry, organized jazz concerts and started an artists\u2019 workshop with his girlfriend, Magdalene Arndt, known as Leni. They married in 1965 and became active in the local counterculture movement. With his friend Pun Plamondon, they started the White Panther Party in 1968.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cWe thought,\u201d Mr. Sinclair wrote in \u201cGuitar Army,\u201d \u201cthat political organization and political theory were things of the past which had no relevance to the contemporary situation, that whatever happened would have to happen spontaneously if it was going to mean anything at all, and that all we had to do was to keep pumping out our propaganda as hard as we could and then just wait for the right moment to present itself, at which time there would be a huge apocalyptic flash and the future of the world would be settled in a matter of days.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But in a matter of months, Mr. Sinclair was in prison. While there, he was indicted along with Mr. Plamondon and another White Panther Party member on charges that they had conspired in 1968 to bomb a C.I.A. recruiting office in Ann Arbor. The case against them was built on wiretaps for which the F.B.I. had not obtained warrants, and it collapsed after the U.S. Supreme Court ruled that the wiretaps <a class=\"css-yywogo\" href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/407\/297\/\" title=\"\" rel=\"noopener\" target=\"_blank\">were unconstitutional<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">John and Leni Sinclair divorced in 1978. He married Patricia Brown in 1989. She survives him, along with two daughters from his first marriage, Celia and Sunny Sinclair; three stepdaughters, Krishna Tyson, Chonita Robinson and Kenya Makeba Carr; a sister, Kathleen Sinclair-Smith; and a granddaughter.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">After his legal problems ended, Mr. Sinclair settled into a life of advocacy, writing poetry and articles for alternative newspapers and producing music festivals. He smoked marijuana every day.
