{"id":33287,"date":"2024-07-10T12:35:30","date_gmt":"2024-07-10T16:35:30","guid":{"rendered":"https:\/\/newssprinters.com\/index.php\/world\/reports-falsely-claim-nigerias-approval-of-samoa-deal-legalises-same-sex-relationships\/10\/07\/2024\/"},"modified":"2024-07-10T12:35:30","modified_gmt":"2024-07-10T16:35:30","slug":"reports-falsely-claim-nigerias-approval-of-samoa-deal-legalises-same-sex-relationships","status":"publish","type":"post","link":"https:\/\/newssprinters.com\/index.php\/world\/reports-falsely-claim-nigerias-approval-of-samoa-deal-legalises-same-sex-relationships\/10\/07\/2024\/","title":{"rendered":"Reports falsely claim Nigeria\u2019s approval of Samoa deal legalises same-sex relationships"},"content":{"rendered":"<p>\n<\/p>\n<div>\n<div class=\"caas-img-container caas-img-loader portrait\" style=\"padding-bottom:124%\"><img alt=\"&lt;span&gt;&lt;\/div&gt;&lt;\/div&gt;&lt;\/div&gt;&lt;div class=\" caption-wrapper=\"\" caption-aligned-with-image=\"\"\/><figcaption class=\"caption-collapse\"><span>Screenshot showing the false claim, taken July 8, 2024<\/span><\/figcaption><\/div>\n<p>The newspaper is Nigeria\u2019s most influential daily in the Muslim-dominated conservative north.<\/p>\n<p>The newspaper reported that Africa\u2019s most populous country had signed a \u201c$150 billion\u201d accord with the EU containing clauses that \u201ccompel underdeveloped and developing nations to support the agitations by the Lesbian, Gay, Bisexual, and Transgender (LGBT) community for recognition, as a condition for getting financial and other support from advanced societies\u201d.<\/p>\n<p>Named after the Pacific Island of Samoa where it was promulgated on November 15, 2023, the treaty is commonly known as the \u201cSamoa Agreement\u201d.<\/p>\n<p>Other Nigerian media like <a href=\"https:\/\/perma.cc\/X6RY-6WA2\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Business Day;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Business Day<\/a> and <a href=\"https:\/\/archive.ph\/49cC3\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Vanguard;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Vanguard<\/a> repeated the claims and shared them with millions of followers on social media.<\/p>\n<p>The articles led to fierce criticism of the government, especially in the country&#8217;s north.<\/p>\n<p>AFP Fact Check <a href=\"https:\/\/factcheck.afp.com\/doc.afp.com.344N7AK\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:debunked;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">debunked<\/a> similar claims about the Samoa agreement in November 2023.<\/p>\n<h2>Web of disinformation<\/h2>\n<p>Daily Trust hinged its claim on an <a href=\"https:\/\/perma.cc\/7BUM-C3TZ\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:opinion article;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">opinion article<\/a> written by Lagos-based lawyer Sonnie Ekwowusi who was one of the first people to reveal Nigeria&#8217;s approval of the Samoa agreement.<\/p>\n<p>\u201cArticles 2.5 and 29.5 legalise LGBT, transgenderism, abortion, teen sexual abuse, and perversity in African countries,\u201d according to Ekwowusi.<\/p>\n<p>\u201cThe signing of the Agreement by Nigeria constitutes a threat to the sovereignty of Nigeria and Africa. It further debases our democracy\u201d.<\/p>\n<p>The Daily Trust wrote that the government inked the deal in secrecy despite \u201cglobal opposition\u201d. The agreement came to light when budget and economic planning minister Atiku Bugudu announced it at a function hosted by the EU in the nation\u2019s capital Abuja on July 1, 2024.<\/p>\n<p>The Daily Trust story sparked <a href=\"https:\/\/perma.cc\/U5VH-YVHL\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:viral social media claims;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">viral social media claims<\/a> about Nigeria legalising same-sex marriages and became a trending topic with keywords like \u201cMuslim-Muslim\u201d and \u201cSamoa agreement\u201d.<\/p>\n<p>Reposting a screenshot of the article, government critic Mahdi Shehu\u00a0<a href=\"https:\/\/perma.cc\/GW5Y-GBXJ\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:wrote on X;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">wrote on X<\/a>: \u201cMay homosexuality, lesbianism, and child abuse be a permanent habit in them, may it run through their children, grandchildren up to the last generation. Areas of priority include human rights, democracy and governance, peace and security; human and social development, inclusive, sustainable economic growth and development, environmental sustainability and climate change; and migration and mobility.<\/p>\n<p>It is seen as a blueprint for strengthening bilateral relations and succeeds the <a href=\"https:\/\/home-affairs.ec.europa.eu\/networks\/european-migration-network-emn\/emn-asylum-and-migration-glossary\/glossary\/cotonou-agreement_en\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Cotonou Agreement;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Cotonou Agreement<\/a> signed in June 2000 (archived <a href=\"https:\/\/perma.cc\/FY4V-EKK5\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:here;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">here<\/a>).<\/p>\n<p>After seven months of deliberations, the Nigerian government\u00a0<a href=\"https:\/\/x.com\/PressACP\/status\/1806722369622577536\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:signed;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">signed<\/a> the accord in Brussels on June 28, 2024, joining 72 other members of the OACPS (archived <a href=\"https:\/\/perma.cc\/5S5D-R6GF\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:here;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">here<\/a>).<\/p>\n<div class=\"twitter-tweet-wrapper\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:June 28, 2024;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">June 28, 2024<\/a><\/p>\n<\/blockquote>\n<\/div>\n<h2>LGBTQ+ not legalised<\/h2>\n<p>Nigeria\u2019s 2013 <a href=\"https:\/\/www.refworld.org\/pdfid\/52f4d9cc4.pdf\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Same-Sex Marriage Prohibition Act (SSMPA);elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Same-Sex Marriage Prohibition Act (SSMPA)<\/a> prohibits rights for LGBTQ+ individuals, and criminalises marriage and civil unions between people of the same sex (archived <a href=\"https:\/\/perma.cc\/92LZ-RNZB\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:here;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">here<\/a>).<\/p>\n<p>Ekwowusi claimed that articles 2.5 and 29.5 of the Samoa agreement mandated gay rights.<\/p>\n<p>However, neither section expressly promotes or even mentions same-sex relationships.<\/p>\n<p>While article 2.5 states that \u201cthe Parties shall systematically promote a gender perspective and ensure that gender equality is mainstreamed across all policies\u201d, article 29.5 says \u201cparties shall support universal access to sexual and reproductive health commodities and healthcare services, including for family planning, information and education, and the integration of reproductive health into national strategies and programmes\u201d.<\/p>\n<figure class=\"caas-figure\">\n<div class=\"caas-figure-with-pb\" style=\"max-height: 2024<\/span><\/figcaption><\/p>\n<\/figure>\n<p>Lagos-based human rights lawyer Festus Ogun said he had not found any details in the written agreement to support the claims.<\/p>\n<p>\u201cI have carefully considered the Samoa Agreement and I do not think that there is anything in the agreement that directly and specifically gives credence to LGBTQ. No agreement can be domesticated as a law without the act of parliament,\u201d he told AFP Fact Check.<\/p>\n<p>\u201cParliament has not repealed the Same Sex Act and the Nigerian constitution provides that no treaty shall be enforceable by court unless enacted into law by the national assembly\u201d.<\/p>\n<p>Tobi Oluwatoba, former executive director of the Centre for Journalism Innovation and Development (CJID), echoed the remarks.<\/p>\n<p>\u201cPrivate morality and public law are separate domains and it is a slippery slope to conflate them. There is no reference to LGBTQ in the document,\u201d he told AFP Fact Check.<\/p>\n<p>\u201cWe shouldn\u2019t be looking for a reason to discriminate against a minority group where there really isn\u2019t one.\u201d<\/p>\n<p>The day the Daily Trust article about the agreement was published, Information Minister Mohammad Idris <a href=\"https:\/\/www.thecable.ng\/fg-no-part-of-samoa-agreement-contravenes-our-laws-it-was-signed-in-countrys-interest\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:denied;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">denied<\/a> that the deal mandated Nigeria to legalise LGBTQ+ rights (archived <a href=\"https:\/\/perma.cc\/48SM-Q3MP\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:here;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">here<\/a>).<\/p>\n<p>He added that the framework of cooperation had been signed with a caveat.<\/p>\n<p>\u201cNigeria\u2019s endorsement was accompanied by a Statement of Declaration, dated 26th June 2024, clarifying its understanding and context of the agreement within its jurisdiction to the effect that any provision that is inconsistent with the laws of Nigeria shall be invalid,\u201d he said.<\/p>\n<h2>Lawsuit threat<\/h2>\n<p>On July 6, the Daily Trust\u00a0<a href=\"https:\/\/dailytrust.com\/samoa-agreement-fg-to-sue-daily-trust\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:told readers;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">told readers<\/a> the government had threatened to sue the paper over the story (archived <a href=\"https:\/\/perma.cc\/GUE6-HNAS\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:here;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">here<\/a>).<\/p>\n<p>In an editorial published a day later, the paper <a href=\"https:\/\/dailytrust.com\/report-on-samoa-agreement-our-position\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:said;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">said<\/a> it would \u201creadily apologise both to the government and to the public for crying wolf\u201d if its interpretation of the agreement was wrong\u00a0(archived <a href=\"https:\/\/perma.cc\/2D3Q-BDN6\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:here;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">here<\/a>).<\/p>\n<p>While the original article was still live on the website on July 10, the Daily Trust said it had \u201calso acknowledged lapses in our reporting on this particular matter, pointed out to us by professional colleagues, and we will review and take appropriate measures\u201d.<\/p>\n<\/div>\n<p><script async src=\"\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><a href=\"https:\/\/www.yahoo.com\/news\/reports-falsely-claim-nigeria-endorsement-154933283.html\" target=\"_blank\" rel=\"noopener nofollow\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Screenshot showing the false claim, taken July 8, 2024 The newspaper is Nigeria&rsquo;s most influential daily in the Muslim-dominated conservative north.
