Muammar el-Qaddafi.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The trial, which is scheduled to last three months, is far from the first for Mr. Sarkozy, 69, a conservative politician who led France from 2007 to 2012, but it represents <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2018\/03\/23\/world\/europe\/nicolas-sarkozy.html?searchResultPosition=19\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">one of the most serious<\/a> legal threats to the French politician since he left office.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Just last month, Mr. Sarkozy exhausted his final appeal <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2021\/03\/01\/world\/europe\/france-sarkozy-trial-guilty.html?searchResultPosition=15\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">in a separate corruption and influence peddling case<\/a>, making him the first former French president sentenced to actual detention, though he will serve his time under house arrest with an electronic bracelet.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But of all the legal cases against Mr. Sarkozy, the Libya one is <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2018\/03\/23\/world\/europe\/nicolas-sarkozy.html?searchResultPosition=19\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">among the most sprawling, convoluted and explosive<\/a>. It involves accusations that his campaign illegally accepted vast sums of money from Colonel Qaddafi, the former Libyan strongman who was killed by opposition fighters in 2011.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sarkozy, who arrived in court without making any comments, has denied wrongdoing. He could face up to 10 years in prison and be fined nearly $400,000.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Here is what you need to know about the case.<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-1476483\">What is the trial about?<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sarkozy is facing charges of illegal campaign financing, criminal conspiracy, concealing the misappropriation of public funds and passive corruption (a charge that applies to people suspected of receiving money or favors).<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The case against him involves a complex web of political and financial ties among Mr. Sarkozy\u2019s advisers, officials who were part of Colonel Qaddafi\u2019s government, and businessmen or bankers who acted as intermediaries.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Twelve other people were also <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/08\/25\/world\/europe\/sarkozy-trial-france-libya-corruption.html?searchResultPosition=10\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">ordered to stand trial<\/a> on similar corruption, embezzlement or illegal campaign financing charges.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cOur thesis is that of a corruption pact,\u201d Jean-Fran\u00e7ois Bohnert, France\u2019s top financial prosecutor, told RMC radio on Monday.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Prosecutors say that Mr. Sarkozy and his allies sought financing from Libya, in violation of election funding rules, and that the Libyan government promised to provide it. In return, they said, it wanted economic deals, diplomatic recognition and possibly assistance from France in rescinding an arrest warrant against a top Libyan official.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sarkozy visited Libya shortly after he was elected, then welcomed Colonel Qaddafi for <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2007\/12\/11\/world\/europe\/11france.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">a widely-criticized state visit<\/a> in Paris, where the Libyan strongman memorably pitched his Bedouin-style tent.<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-40cc18f8\">How did the case start?<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">In 2011, as Libya was roiled by <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2011\/03\/12\/world\/africa\/12libya.html?searchResultPosition=1\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">fighting between the army and rebels<\/a>, Colonel Qaddafi and his son said in <a class=\"css-yywogo\" href=\"https:\/\/www.euronews.com\/2011\/03\/16\/exclusive-saif-al-gaddafi-wants-money-back-from-sarkozy\" title=\"\" rel=\"noopener\" target=\"_blank\">media interviews<\/a> that Mr. Sarkozy\u2019s 2007 presidential campaign had taken Libyan money.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Then, in 2012, the investigative news website Mediapart <a class=\"css-yywogo\" href=\"https:\/\/www.mediapart.fr\/journal\/international\/280412\/sarkozy-kadhafi-la-preuve-du-financement\" title=\"\" rel=\"noopener\" target=\"_blank\">published<\/a> a document, presented as a note by Libya\u2019s secret services, that mentioned a deal to fund Mr. Sarkozy\u2019s campaign with up to 50 million euros, or about $52 million. That same year, as part of a separate investigation, Ziad Takieddine, a French-Lebanese businessman, made a similar allegation.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In 2013, prosecutors opened an investigation. It lasted a decade and involved over 20 countries, 50 police raids and 70 volumes of case files.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-757bc2dc\">How has Mr. Sarkozy responded?<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sarkozy has repeatedly and strenuously denied the accusations, which he argues were driven mostly by allies of Colonel Qaddafi seeking revenge.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Under Mr. Sarkozy\u2019s leadership, France played a prominent role in the NATO-led campaign of airstrikes that ultimately led to the toppling of Colonel Qaddafi and <a class=\"css-yywogo\" href=\"http:\/\/www.nytimes.com\/2011\/10\/21\/world\/africa\/qaddafi-is-killed-as-libyan-forces-take-surt.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">his death at the hands of Libyan rebels<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">There have been conflicting accounts about the sequence of events and the amounts of money involved, and some of the defendants have shifted their versions of what happened.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Some Libyan officials have even denied that Mr. Sarkozy\u2019s campaign received any funding, and Mr. Sarkozy\u2019s legal team has seized on the vagaries of the case.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cWe don\u2019t even have the amount of this alleged illegal financing,\u201d Christophe Ingrain, Mr. Sarkozy\u2019s lawyer, <a class=\"css-yywogo\" href=\"https:\/\/www.rtl.fr\/actu\/justice-faits-divers\/soupcons-de-financement-libyen-ce-n-est-pas-serieux-clame-l-avocat-de-nicolas-sarkozy-7900457479\" title=\"\" rel=\"noopener\" target=\"_blank\">told RTL radio on Sunday<\/a>. \u201cSometimes it\u2019s in euros, sometimes in dollars, sometimes in dinars, sometimes 2 million, 3 million, 50 million, 400 million. This isn\u2019t serious.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sarkozy\u2019s official records for the 2007 campaign indicated that he spent over \u20ac21 million, and any illicit financing from Libya would have enabled him to skirt France\u2019s strict spending cap for presidential campaigns. Prosecutors have not clearly laid out how much Libya actually sent or how much they believe was actually spent on the campaign. But under French law, prosecutors do not have to prove that a corrupt deal was carried out to secure a conviction \u2014 only that one was agreed upon.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sarkozy no longer holds public office. But <a class=\"css-yywogo\" href=\"https:\/\/www.lemonde.fr\/en\/france\/article\/2023\/08\/22\/nicolas-sarkozy-s-selective-memory_6103063_7.html\" title=\"\" rel=\"noopener\" target=\"_blank\">his memoirs are best-sellers<\/a>, he is still popular with the base of his conservative party and he retains <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/08\/27\/world\/europe\/former-french-president-voice-russia.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">some political influence<\/a>.<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-5e38be38\">Has Mr. Sarkozy been convicted before?<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">Yes, twice. Mr. Sarkozy has faced multiple accusations of financial impropriety since he left office.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In 2021, he became the first former president in France\u2019s recent history to be sentenced to actual detention after he was <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2021\/03\/01\/world\/europe\/france-sarkozy-trial-guilty.html?searchResultPosition=15\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">convicted<\/a> of trying to obtain information from a judge about a court case against him.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sarkozy has exhausted his appeal options in that case, but he will not be incarcerated. Instead, he will serve one year under house arrest with an electronic bracelet, although a judge has not yet ruled on the practical details.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sarkozy was also <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2021\/09\/30\/world\/europe\/france-sarkozy-campaign-spending.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">convicted<\/a> in 2021 to a year of house arrest for illegally financing his <a class=\"css-yywogo\" href=\"http:\/\/www.nytimes.com\/2012\/05\/07\/world\/europe\/hollande-and-sarkozy-in-crucial-runoff-in-france.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">unsuccessful 2012 re-election<\/a> campaign, which wildly exceeded France\u2019s spending limits. An appeals court last year upheld the conviction but <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/02\/14\/world\/europe\/nicolas-sarkozy-verdict.html?searchResultPosition=7\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">halved<\/a> his sentence, and that case is still going through the appeals process.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Other cases against Mr. Sarkozy have been <a class=\"css-yywogo\" href=\"http:\/\/www.nytimes.com\/2013\/10\/08\/world\/europe\/french-judges-drop-sarkozy-investigation.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">dropped<\/a>, including one in which we was accused of <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2017\/09\/21\/world\/europe\/liliane-bettencourt-dead-loreal.html\" title=\"\" target=\"_blank\" rel=\"noopener nofollow\">manipulating the heiress to the L\u2019Or\u00e9al fortune<\/a> into financing his 2007 campaign.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">And some cases are still being investigated, including an offshoot of the Libya case.
