{"id":52108,"date":"2025-08-31T10:23:55","date_gmt":"2025-08-31T14:23:55","guid":{"rendered":"https:\/\/newssprinters.com\/index.php\/world\/mexicos-first-elected-supreme-court-faces-critical-test-of-independence\/31\/08\/2025\/"},"modified":"2025-08-31T10:23:55","modified_gmt":"2025-08-31T14:23:55","slug":"mexicos-first-elected-supreme-court-faces-critical-test-of-independence","status":"publish","type":"post","link":"https:\/\/newssprinters.com\/index.php\/world\/mexicos-first-elected-supreme-court-faces-critical-test-of-independence\/31\/08\/2025\/","title":{"rendered":"Mexico&#8217;s first elected Supreme Court faces critical test of independence"},"content":{"rendered":"<p>\n<\/p>\n<div data-article-body=\"true\">\n<p class=\"mb-4 text-lg md:leading-8 break-words\">MEXICO CITY (AP) \u2014 Mexico\u2019s first elected Supreme Court will be seated Monday and observers will be watching closely to see whether it will <a href=\"https:\/\/apnews.com\/article\/mexico-judicial-election-supreme-court-6f80e045ca06d601f8602e7d68dfd502\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:assert its independence;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">assert its independence<\/a> from the governing party that held the country\u2019s first judicial elections.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Just three of its nine justices have any experience on the high court, the rest are new, including the court\u2019s president Hugo Aguilar, a lawyer who spent his career defending Indigenous rights.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The idea of judicial elections came from Mexico\u2019s former <a href=\"https:\/\/apnews.com\/hub\/andres-manuel-lopez-obrador\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:President Andr\u00e9s Manuel L\u00f3pez Obrador;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">President Andr\u00e9s Manuel L\u00f3pez Obrador<\/a>, who frequently clashed with judges who challenged his agenda. He said judges elected by the people would be more accountable and less corrupt. Critics said electing judges risked politicizing the judiciary.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The election was supposed to be nonpartisan, but there were instances of voting pamphlets being distributed that identified candidates linked to the governing party. Many voters were simply <a href=\"https:\/\/apnews.com\/article\/mexico-election-judges-morena-vote-sheinbaum-candidates-668c893433d2cd8dbae07a039c47293b\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:overwhelmed by the 7,700 candidates;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">overwhelmed by the 7,700 candidates<\/a> vying for more than 2,600 judicial positions.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The Supreme Court, however, will receive special attention. It had been a counterweight at times to the popular L\u00f3pez Obrador, whose Morena party also now holds majorities in both chambers of Congress.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cIf the court wants to ensure its independence, it cannot rule in a partisan manner simply to support the government\u2019s position,\u201d said Juanita Goebertus, Americas director for Human Rights Watch. \u201cIt must base its positions on law.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The court has nearly 1,400 pending cases. Here are some that stand out:<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Mandatory pretrial detention<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">It\u2019s an issue that has brought broad international criticism to Mexico. L\u00f3pez Obrador expanded the crimes for which someone is automatically jailed pending trial, <a href=\"https:\/\/apnews.com\/article\/mexico-crime-caribbean-arrests-violent-1e23520f2d25aa2cf3e31ebaad9a2d08\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:including for some nonviolent crimes;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">including for some nonviolent crimes<\/a>. The policy appears to violate international treaties which Mexico has signed.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The U.N. High Commissioner for Human Rights Office and the Inter-American Court on Human Rights are among the bodies that have called for Mexico to repeal the policy.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The Mexican government says that it is a necessary tool to take on criminal activity and to protect judges.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">But in a country where cases can drag on for years without a trial reaching a conclusion and only one in five of those charged are convicted, critics say the policy violates their rights. Four of every 10 people in Mexican prisons had not been convicted in 2023, according to the Federal and State Penitentiary Systems census.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The previous court declined to take it up in its final days.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Abortion access<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">While the previous court made historic rulings in 2021 and 2023 to expand access to abortion, the new court will likely have to weigh in on challenges to states that still have abortion on the books as a crime in their penal codes.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The court\u2019s <a href=\"https:\/\/apnews.com\/article\/mexico-abortion-decriminalize-supreme-court-82cd9798abe91106fda1e7afddf91c34\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:2023 ruling invalidated all federal criminal penalties;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">2023 ruling invalidated all federal criminal penalties<\/a>, saying they were an unconstitutional violation of women\u2019s human rights. However, under Mexico\u2019s legal system, the ruling did not apply to state statutes, which must be changed state by state.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Ana C\u00e1rdenas, director of justice projects in Mexico for the World Justice Project, said that uncertainty will prevail about whether the new court will preserve the same line of legal reasoning of recent years on the issue until the justices take up the cases.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Transgender rights<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Previous courts have handed down decisions expanding transgender rights, for example by ruling that civil registry offices must allow transgender people to change the gender on their birth certificate through an administrative procedure without going before a judge.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The court extended that right to children in 2022.
