{"id":53374,"date":"2025-10-16T15:54:59","date_gmt":"2025-10-16T19:54:59","guid":{"rendered":"https:\/\/newssprinters.com\/index.php\/world\/lawyers-ask-icc-to-investigate-122-european-officials-for-crimes-against-humanity-in-mediterranean\/16\/10\/2025\/"},"modified":"2025-10-16T15:54:59","modified_gmt":"2025-10-16T19:54:59","slug":"lawyers-ask-icc-to-investigate-122-european-officials-for-crimes-against-humanity-in-mediterranean","status":"publish","type":"post","link":"https:\/\/newssprinters.com\/index.php\/world\/lawyers-ask-icc-to-investigate-122-european-officials-for-crimes-against-humanity-in-mediterranean\/16\/10\/2025\/","title":{"rendered":"Lawyers ask ICC to investigate 122 European officials for crimes against humanity in Mediterranean"},"content":{"rendered":"<p>\n<\/p>\n<div data-article-body=\"true\">\n<p class=\"mb-4 text-lg md:leading-8 break-words\">BARCELONA, Spain (AP) \u2014 The European Union&#8217;s cooperation on migration with the fractured North African nation of Libya is in the spotlight again after human rights lawyers filed the names of some 120 European leaders &#8211; including French President Emmanuel Macron and former German Chancellor Angela Merkel &#8211; to the International Criminal Court, accusing them of committing <a href=\"https:\/\/apnews.com\/article\/998475228a944e6ea7f4b005f9e1c293\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:crimes against humanity;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">crimes against humanity<\/a> with migrants in the Mediterranean Sea.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The group led by lawyers Omer Shatz and Juan Branco filed a 700-page legal brief on Thursday. The Associated Press has obtained a copy of the brief.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Their case is based on six years of investigation, interviews with more than 70 senior European officials, minutes of high-level European Council meetings and other confidential documents. It follows a previous request to the ICC&#8217;s prosecutor\u2019s office to investigate European officials for migration policies they argued led to the interception, detention, torture, killing and drowning of tens of thousands of people trying to reach European shores.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">That request, filed in 2019 and admitted in 2020 as part of the <a href=\"https:\/\/apnews.com\/article\/libya-icc-mass-grave-tarhunah-warrants-fbea7b19cd0d5cfd5f44b35be2dc88cf\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:ICC's Libya investigation;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">ICC&#8217;s Libya investigation<\/a>, did not cite any specific suspects by name.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Now, lawyers say they have identified dozens of European individuals, from high-level heads of state to lower-level bureaucrats, as \u201cco-perpetrators\u201d alongside Libyan suspects for the death of 25,000 asylum seekers and abuses against some 150,000 survivors who were \u201cabducted and forcibly transferred to Libya, where they were detained, tortured, raped, and enslaved.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">European leaders, officials called out by name<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cWe did the work of the office of the prosecutor, we managed to get to the inside of this apparatus of power and deconstruct it to see which offices, which ministries and which individuals (are responsible),\u201d Shatz said. \u201cWe feel confident to say that at least 122 are criminally liable.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">ICC&#8217;s <a href=\"https:\/\/apnews.com\/article\/un-icc-prosecutor-khan-sexual-misconduct-d826e69abfbedacef2b270ffe410610d\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:prosecutor Karim Khan;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">prosecutor Karim Khan<\/a> stepped aside earlier this year pending the outcome of a sexual misconduct investigation against him.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Lawyers published an online database with parts of their case and their \u201csuspect list\u201d naming each of the 122 individuals, their roles and why they believe the person to be liable. Among them is NATO Secretary-General Mark Rutte, who was then prime minister of the Netherlands, Polish Prime Minister Donald Tusk, then former president of the European Council, European former foreign policy chief Frederica Mogherini and former Frontex chief Fabrice Leggeri, to cite a few.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Shatz and Branco are not the only ones to have urged the ICC to <a href=\"https:\/\/apnews.com\/article\/middle-east-africa-crime-libya-europe-2acdadce5904a7ec40eea7a6b289642d\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:investigate abuses committed;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">investigate abuses committed<\/a> against migrants in Libya and the Mediterranean Sea. In 2023, a <a href=\"https:\/\/apnews.com\/article\/libya-migrants-crimes-against-humanity-542ac141d79d65641377255730391e23\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:U.N.-backed investigation;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">U.N.-backed investigation<\/a> also concluded the EU&#8217;s support to Libyan forces contributed to crimes against migrants and called on EU authorities to review their policies with Libya.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThe law of the ICC was born out of European crimes but only applied so far to crimes committed outside of Europe,\u201d Shatz told the Associated Press. \u201cOur request is simple: to apply the law impartially, also upon European nationals.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">EU says cooperation with Libya on migration still a priority<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Despite repeated calls from human rights experts for Europe to refrain from supporting Libyan forces in stopping migrants from crossing the Mediterranean, European officials remain determined to continue doing just that.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Libya <a href=\"https:\/\/apnews.com\/article\/libya-derna-dams-collapse-floods-corruption-neglect-chaos-45f76d2ac76be634865539a27b518ada\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:plunged into chaos;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">plunged into chaos<\/a> after a NATO-backed uprising toppled and killed longtime dictator <a href=\"https:\/\/apnews.com\/hub\/muammar-gadhafi\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Moammar Gadhafi;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Moammar Gadhafi<\/a> in 2011. In the chaos that followed, the country split, with rival administrations in the east and west backed by rogue militias and foreign governments. In recent months, there has been an increase in migrant departures from <a href=\"https:\/\/apnews.com\/article\/greece-libya-migration-eu-6c956d2a6ce317e334848dc7baa08d4d\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:eastern Libya to Greece,;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">eastern Libya to Greece,<\/a> which <a href=\"https:\/\/apnews.com\/article\/migration-eu-libya-753134ad397be86687688a32b51f707f\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:European officials;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">European officials<\/a> have been trying to address.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The EU says it has been working with Libyan authorities \u201cto protect migrants and refugees\u201d in Libya, \u201cwhile taking action to reduce irregular departures through border management and anti-smuggling and trafficking in human beings.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">It has repeatedly defended its cooperation with Libya and its migration policy and blames migrant deaths on people smugglers and human traffickers who profit off their misery.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThe situation in Libya is critical,\u201d EU Commission spokesperson Markus Lammert told journalists last week. \u201cWe will continue our engagement with all actors involved.&#8221;<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Rival Libyan officials visit EU border agency<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Just yesterday, the EU hosted both eastern and western Libyan officials for a technical visit of the bloc&#8217;s border and coast guard agency&#8217;s headquarters in Warsaw. The visit was remarkable for bringing both sides of Libya&#8217;s rival governments into the same room.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThe atmosphere was open and constructive, and the Libyan side showed real curiosity about how Frontex and the EU work,\u201d Chris Borowski, a spokesperson for Frontex told AP in writing. \u201cIt was a good first step toward building mutual understanding.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Human rights groups, including non-governmental organizations that rescue migrants in the Mediterranean, criticized the visit.
