{"id":60746,"date":"2026-07-07T08:21:06","date_gmt":"2026-07-07T12:21:06","guid":{"rendered":"https:\/\/newssprinters.com\/index.php\/world\/why-netanyahu-rejected-compromise-with-noam-sohlberg-in-probing-october-7\/07\/07\/2026\/"},"modified":"2026-07-07T08:21:06","modified_gmt":"2026-07-07T12:21:06","slug":"why-netanyahu-rejected-compromise-with-noam-sohlberg-in-probing-october-7","status":"publish","type":"post","link":"https:\/\/newssprinters.com\/index.php\/world\/why-netanyahu-rejected-compromise-with-noam-sohlberg-in-probing-october-7\/07\/07\/2026\/","title":{"rendered":"Why Netanyahu rejected compromise with Noam Sohlberg in probing October 7"},"content":{"rendered":"<p>\n<\/p>\n<div data-article-body=\"true\">\n<p class=\"mb-4 text-lg md:leading-8 break-words\">It has become clear that Netanyahu and the government&#8217;s problem with a state inquiry was not activist judges, but their desire to navigate the results to not be overly negative for themselves.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The Knesset&#8217;s vote on Monday night approving a <a href=\"https:\/\/www.yahoo.com\/news\/politics\/articles\/knesset-passes-first-reading-bill-212430613.html\" data-ylk=\"elm:link;elmt:article_link;slk:first reading;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;first reading&quot;}\" class=\"link  yahoo-link\" target=\"_blank\" rel=\"noopener nofollow\">first reading<\/a> of a politicized probe of the October 7 disaster, may have put the final nail in the coffin for getting out the full truth of all of what led to Israel being blindsided by Hamas that day.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Contrary to what parties on both sides of the issue portray as their solution being the only right solution, there was a serious compromise that was briefly dangled before the sides and which could have gotten to the truth and accomplished some healing between this countries politically-warring class.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The solution was that instead of High Court President Isaac Amit selecting or running the state inquiry, High Court Deputy President Noam Sohlberg could have taken on that role.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Amit is currently loathed by Prime Minister Benjamin Netanyahu and the government&#8217;s political camps within Israel.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The truth is that his decisions over the years categorize him as far more moderate than Aharon Barak, Dorit Beinisch, and other overtly activist justices, but he is still definitely not a conservative, and he lit the country&#8217;s right-wing on fire by refusing to allow Justice Minister Yariv Levin to appoint certain candidates to the High Court and by refusing to let a conservative take over the High Court in his place.<\/p>\n<figure class=\"relative mb-4\">\n<div class=\"relative\"><button aria-label=\"View larger image\" class=\"group absolute bottom-0 size-full\" data-ylk=\"elm:expand;itc:1;sec:image-lightbox;slk:lightbox-open;\"><span class=\"absolute bottom-3 right-3 rounded-full bg-primary p-3 opacity-100 shadow-elevation-3 transition-opacity duration-300 group-hover:block group-hover:opacity-100 md:p-[17px] lg:bottom-6 lg:right-6 lg:bg-primary\/90 lg:p-5 lg:opacity-0 lg:shadow-none\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"24\" height=\"24\" viewbox=\"0 0 24 24\" aria-hidden=\"true\" focusable=\"false\" class=\"flex-none size-4 -scale-x-100 text-primary lg:size-6 [&amp;_path]:fill-current\"><path fill=\"currentColor\" d=\"M3.1 3.1V11h1.8V6.314l5.392 5.393 1.415-1.414L6.313 4.9H11V3.1zm17.8 17.8V13h-1.8v4.686l-5.393-5.393-1.415 1.414 5.393 5.393H13v1.8z\"\/><\/svg><\/span><\/button><dialog aria-label=\"Modal Dialog\" aria-modal=\"true\" class=\"fixed bottom-0 left-0 right-0 top-0 z-4 size-full max-h-none max-w-none bg-primary hidden\"\/><\/div><figcaption class=\"relative text-sm mt-1 pr-2.5\">\n<p>Supreme Court Justice Noam Sohlberg attends a court hearing at the Supreme Court in Jerusalem on petitions seeking to overturn the election of attorney Michael Rabello as State Comptroller, June 18, 2026. (credit: YONATAN SINDEL\/FLASH90)<\/p>\n<\/figcaption><\/figure>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">But Amit was ready to take the high ground and step aside regarding control over a state inquiry probe of October 7, and to give that role to Sohlberg, who is the prince of the legal conservative movement in Israel and lives in the West Bank.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Opposition officials did not love the idea because they believe a conservative like Sohlberg might be too deferential toward the government in general, whether Netanyahu or anyone else, as part of the conservative ideology&#8217;s belief that judges should not second guess the executive branch too much on matters of security and policy. Nevertheless, they were willing to go for it to break the standoff.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Netanyahu and the government dismissed it without a second thought, ignoring that <a href=\"https:\/\/www.yahoo.com\/news\/politics\/articles\/judge-solberg-orders-ben-gvir-092834015.html\" data-ylk=\"elm:link;elmt:article_link;slk:Sohlberg;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;Sohlberg&quot;}\" class=\"link  yahoo-link\" target=\"_blank\" rel=\"noopener nofollow\">Sohlberg<\/a> is a conservative, and switching from their attack on the court&#8217;s activist wing to alleging that the entire judicial branch is not trustworthy.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">They presented no evidence for this, since no one can possibly question the conservative credentials of someone like Sohlberg.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">At this point it became clear that Netanyahu and the government&#8217;s problem with a state inquiry was not activist judges, but their desire to navigate the results to not be overly negative for themselves.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In terms of ideology, Sohlberg would definitely be on their side. But in terms of fact-finding, they could not trust that a career-long judge like Sohlberg would sufficiently ignore negative findings so as to provide their preferred picture of blaming the IDF and Shin Bet (Israeli Security Agency) for almost all issues related to October 7.<\/p>\n<h3 class=\"mb-4 text-lg font-bold\">Government excludes IDF, judicial officials from inquiry panel<\/h3>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">This becomes even more clear with the conditions for membership for the government&#8217;s proposed panel for the inquiry: no one who was a top IDF or judicial official dating back to 2005 can participate.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">It would be understandable to exclude any such officials who have been involved in politics recently, such as Benny Gantz, <a href=\"https:\/\/www.yahoo.com\/news\/politics\/articles\/netanyahu-criticizes-gantz-eisenkot-over-035408597.html\" data-ylk=\"elm:link;elmt:article_link;slk:Gadi Eisenkot;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;Gadi Eisenkot&quot;}\" class=\"link  yahoo-link\" target=\"_blank\" rel=\"noopener nofollow\">Gadi Eisenkot<\/a>, and Gabi Ashkenazi.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">But why can&#8217;t Shaul Mofaz, retired from politics since 2015 and formerly defense minister and IDF chief, be involved?<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Incidentally, then-IDF chief Herzi Halevi tried to bring Mofaz in to probe himself in January 2024, but Netanyahu blocked this and any other such higher level probe, lest the probe also lead to Netanyahu himself even indirectly, leading to no one probing Halevi.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">One can understand why Netanyahu would oppose Aharon Barak and Dorit Beinisch, but why can&#8217;t former retired conservative justices of the High Court be involved in the probe?<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">It becomes clear that the concern is not fairness, but trying to ensure and dictate a less negative result &#8211; regardless of the facts.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The attempted cover for this cover-up is to make the panel be half selected by the government and half by the opposition.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Netanyahu and his supporters say this guarantees fairness and equality because all sides of the political spectrum will have representation.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">To their credit, it is certainly a much more fair proposal than if they suggested a panel controlled only by the government.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">But really what it does is guarantee that any decision by the panel will be inherently political and part of backroom dealing, relating also to other political issues which might be going on at the time.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">This is the opposite of an apolitical inquiry divorced from external influences, and focused only on where the facts lead.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Under the government&#8217;s proposal, if the government and opposition officials cannot agree on certain findings, either the government could in some scenarios get its way, or the panel would be indefinitely stalled, which would still avoid any negative claims against Netanyahu and the government.<\/p>\n<h3 class=\"mb-4 text-lg font-bold\">Netanyahu remains unpunished for October 7 failure<\/h3>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">None of this is to prejudge what an objective inquiry should or would find, and none of this frees the IDF and the Shin Bet from sharing the blame for October 7 with the political class.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Yet anyone who says that Netanyahu and the government are or would be treated unfairly also ignores that all of the other officials in power on October 7 were forced to resign long ago: from former IDF intelligence chief Aharon Haliva, to Halevi, to former Shin Bet chief Ronen Bar, to former defense minister Yoav Gallant, to former southern command chief Yaron Finkelman, to former Unit 8200 chief Yossi Sariel, to so many others.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In other words, all of the other officials involved in the<a href=\"https:\/\/www.jpost.com\/tags\/the-october-7-massacre\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"elm:link;elmt:article_link;slk:October 7;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;October 7&quot;}\" class=\"link \">October 7<\/a> disaster have already paid the price for their failures.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Arguments can be made in both directions regarding Netanyahu&#8217;s policies for containing Hamas and avoiding larger wars, avoiding peace negotiations, allowing Qatar to funnel funds to Hamas, allowing Itamar Ben-Gvir to inflame the Temple Mount situation, regarding the judicial overhaul and who is to blame for Hamas&#8217;s perception that the IDF was weakened by internal dissent, but until an apolitical inquiry looks into the issues, questions the prime minister and all of the other officials under oath, and presents both sides to the public &#8211; Israel will not get to the full truth of the disaster.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In the meantime, approving the first reading of this law pushes the opposition away from any compromise.
